Space Requires New Thinking, Practices, Lynn Says

WASHINGTON, Nov. 3, 2010 - Once the private preserve of the United States and the Soviet Union, space has become "congested, contested and competitive," requiring a shift in the military space community's thinking and practices, Deputy Defense Secretary William J. Lynn III said today.
In remarks prepared for delivery at a U.S. Strategic Command space symposium in Omaha, Neb., Lynn noted that the United States has "derived tremendous benefits from its presence in space" for more than 50 years.
"We are -- and continue to be -- the world's pre-eminent leader in space," he said. "But the environment we operate in has changed so markedly that we have reached a historical inflection point."
Space has become congested, he said, because 60 nations now have a presence there. "Nine-thousand satellite transponders will be active by 2015," he noted, "and the skies over Earth are so cluttered with debris that further collisions could eventually put usable orbits in jeopardy."
Dozens of countries in space with various agendas, Lynn said, constitute the "contested" portion of today's space environment. "We cannot take the stability or sustainability of space -- or access to it -- for granted."
"It used to be said that the primary threat to a satellite was launch failure," he told the audience. "Now, many countries can hold space systems at risk through kinetic and nonkinetic means. Some nations are even jamming satellite signals to censor news, illustrating how counter space capabilities can be used for political as well as military purposes."
Competition is a factor, Lynn explained, because the United States once owned three-quarters of global business, but now accounts for little more than a quarter of that business.
President Barack Obama's space policy, announced in June, recognizes the shift in the space environment, and the Defense Department of Defense can bring four crucial elements to its military space activities, Lynn said. Those elements, he added, will form the basis of the National Security Space Strategy, which the Defense Department will release jointly with the director of national intelligence this fall.
The elements are:
-- A move toward the sustainability and stability of the space domain;
-- A renewed emphasis on international cooperation;
-- Expanding how the United States protects space systems in a contested environment; and
-- Improvement of space system development and acquisition.
Lynn called sustaining and stabilizing space a "vital national interest" that demands a cooperative and predictable environment to minimize accidents or interference. To that end, he said, the new space policy calls for "bilateral and multilateral transparency and confidence-building measures which will help establish norms of behavior in space."
"Along with the right to use and explore space comes the responsibility to be a good steward of it," he added.
The president's space policy incorporates international cooperation, Lynn said. While the United States has such a partnership with Australia on the Wideband Global Satellite Communications System, Lynn said, Stratcom is looking into ways to add concepts from the "joint" Space Operations Center into a "combined" Space Operations System.
"Turning our Space Operations Center into a coalition enterprise, with close allies working side by side with our own commanders, could bring levels of cooperation to new heights," he said.
Ways to share resources with allies also is critical, he said, such as missile warning and maritime awareness.
"Coalitions and partnerships, with both nations and firms, will not only help us achieve our security objectives in space more efficiently," Lynn said, "they will also fundamentally strengthen our space posture," he said.
The new space policy directs DOD to assure mission-essential functions, even when they are degraded or disrupted, Lynn pointed out. "Achieving this will entail expanding how we protect our space systems in a contested environment," he said, noting that resilience is the key to deterrence in the U.S. national security strategy.
"Making our space systems more resilient, and our combat power less reliant on their full functioning will help deny adversaries the benefit from an attack in space," he said. "Just as in the cyber domain, denying the benefit of attack can join retaliatory deterrence as a disincentive to adversaries." Alliances with other nations also are essential to strengthen the U.S. deterrent posture, he added.
The United States has another challenge besides handling the congested, competitive and contested space environment, Lynn said.
"The fiscal climate our nation faces, as well as the globalization of the aerospace industry, makes it even more difficult to maintain our competitive advantage in space," the deputy secretary said. "To preserve our current advantage, we must become better buyers of space systems and work to ensure the health of our space industrial base."
Export control reform is integral as a priority in the nation's efforts in space, he noted.
"We recognize that controlling sensitive space exports is of particular concern to Congress," he said. "We are serious about building 'higher fences' around our most sensitive technologies, while de-listing those items whose export does not threaten our security."
DOD also must improve space acquisition to succeed, Lynn said.
"Block buys and the deliberate management of the engineering work force are two avenues in particular we are actively exploring," he said. "Block buys have the potential to reduce costs and timelines by creating more predictable demand and allowing larger material buys with fewer spares. Establishing a predictable demand schedule has the added advantage of stabilizing the engineering work force associated with a project."
Lynn said the new national space policy affirms the centrality of space to national security and seeks to maintain advantages in the face of an evolving space environment.
"The fundamental mission of the Department of Defense to deter war and to protect the security of our country stays the same," he said. "But how we use space capabilities to achieve this mission will change."

LAREDO, Texas -- State agencies, local jurisdictions and eligible nonprofit organizations in Calhoun County that suffered damage or loss as a result of Hurricane Alex and subsequent flooding now can register for federal assistance.
Public Assistance is being made available to Calhoun County after officials from the Federal Emergency Management Agency (FEMA) and the Texas Division of Emergency Management (TDEM) reviewed damage assessments.
A briefing for Public Assistance applicants in Calhoun County will be held at 1:30 p.m., Tuesday, Sept. 7. The event will be at the Calhoun County Courthouse, 211 S. Ann, Ste. 301, Port Lavaca, TX.
Today's amendment to the presidential disaster declaration of August 3 authorized all categories of Public Assistance for Calhoun County. State agencies, local jurisdictions and eligible nonprofit organizations in these counties are eligible for reimbursement for debris removal, emergency protective measures, and the repair, restoration, reconstruction or replacement of public facilities, roads and bridges, water facilities and other infrastructure damaged or destroyed by Hurricane Alex. FEMA's Public Assistance program will reimburse a minimum of 75 percent of eligible costs.
Under the presidential declaration, Individual Assistance and all categories of Public Assistance are available in seven other counties: Cameron, Hidalgo, Jim Hogg, Maverick, Starr, Webb and Zapata, with Individual Assistance only available in Val Verde County. Federal funding also is available to state and eligible local governments and certain private nonprofit organizations in Cottle, Dawson, Floyd, Foard, Garza, Jim Wells, Lamb, Lubbock, Lynn, Motley, Terry and Willacy counties on a cost-sharing basis for emergency work and the repair or replacement of facilities damaged by Hurricane Alex.

Leads to Seizures of Cocaine, Heroin, Guns and Cash
ROCHESTER, N.Y. (October 27, 2010) - Attorney General Andrew M. Cuomo today announced narcotics trafficking and other charges have been filed against 29 individuals accused of taking part in a drug distribution network that was funneling cocaine and heroin from Puerto Rico and Philadelphia to Rochester, Buffalo and elsewhere in New York.
As part of a multi-agency investigation code-named “Operation Liberty,” federal, state and local law enforcement agents led by the New York State Attorney General’s Organized Crime Task Force (OCTF), The New York State Police and the Greater Rochester Area Narcotics Enforcement Team conducted a 6 month long investigation that included undercover operations, hundreds of hours of covert surveillance, and wiretaps. The investigation led to the seizure of more than 3 1/2 kilograms of cocaine with an estimated street value of $140,000, a half pound of heroin with an estimated street value of $130,000, eight guns, and in excess of $250,000 cash.
Among those indicted was Roberto Rivera-Diaz who is the network's narcotics source in Puerto Rico. According to the charges, Rivera-Diaz arranges with co-conspirator Miguel Saez who resides in Buffalo to send shipments of narcotics via the United States mail to his brother Luis Saez and his associates in Rochester, where a portion of the narcotics were prepared and distributed. Rivera-Diaz and the Saez brothers are charged with the Operating as a Major Trafficker (§220.77(1) of the Penal Law of the State of New York) that went into effect last year as part of changes to the Rockefeller-era drug laws and is the only felony narcotics charge in the state that carries a possible life sentence.
“Working with our law enforcement partners at the federal, state, and local level, we were able to remove guns from our streets and stop this flow of illegal narcotics into our neighborhoods,” said Attorney General Cuomo. “Since 2007, this coordinated approach has resulted in the seizure of dozens of guns and charges against hundreds of individuals across the state. In this case, all those indicted have been charged with felonies, and the alleged ringleaders are facing possible life sentences.”
These three indictments are the culmination of a major investigation led by Attorney General Cuomo’s OCTF and is part of his ongoing efforts to combat narcotic trafficking and other crimes through his Upstate Guns, Gangs, and Drugs Initiative.
Cuomo’s Organized Crime Task Force has conducted a multitude of operations in cooperation with local, state, and federal authorities over the last four years and has charged more than 530 defendants and seized more than $6 million in drugs and cash, as well as dozens of guns.

The charges against the defendants are merely accusations and the defendants are presumed innocent until and unless proven guilty.

"The human toll – the fear, the stigma, and the hard work of recovery ahead for our troops and their families – these are the real costs of war," he said. Navy Adm. Mike Mullen, chairman of the Joint Chiefs of Staff, spoke at a Business Executives for National Security dinner in New York honoring David and Mary Boies with the organization's Eisenhower Award. He said the Boieses and other BENS members' efforts demonstrate their passion to give back to the country. "National security is not just the purview of the military or the government," Mullen said. "But ... I think for many of our fellow citizens, the military remains an abstraction." While it's clear Americans love and support the nation's troops and their families, he said, "My fear is that we're losing touch." Servicemembers and their families commonly have endured five yearlong or up to 25 shorter deployments since 2003, he said. "From the everyday sacrifices of missed birthdays, soccer games and special moments each family cherishes, to the physical and psychological repercussions attached to the post-combat experience, these are lives forever changed," Mullen said. "Long and frequent absences are testing their resilience," he added. "They want to know, 'How many deployments can a marriage take?'" Veterans struggle with the combined stress of combat missions, family separations and eventual reintegration into civilian life, Mullen said. "Military families live in a war zone of their own," he said. "The pressure to try to bear up with a stiff upper lip is driving some to leave the service or – most tragically – to leave this life." He said many veterans have a hard time translating military experience into viable jobs, particularly in a burdened economy. Transition challenges, post-traumatic stress, strain on families, health care demands, rising homelessness among veterans, and the silent epidemic of suicide all paint a stark forecast, the chairman said. "There must be a sense of urgency here," Mullen told the audience. "The sooner we empower our veterans and their families through these transitions, the less likely they will spiral downward." Mullen praised the Boieses and other BENS members for the organization's "Warrior Gateway" website, which he said helps connect veterans' needs with the right community resources and programs. "Many veterans either can't find the services they need or are overwhelmed by the maze of options," he said. "Reducing the information barrier, as Warrior Gateway does so well ... can help put our veterans and their families on the right path." That's an important piece, Mullen said, because it gives veterans a voice and allows them to help guide others facing the same issues. "They are not burdens, they are assets. CBP Catches Imposter Wanted for Felony
Foils More Than 200 Other Illegal Immigration Attempts over Weekend
San Diego — U.S. Customs and Border Protection (CBP) officers at the San Ysidro port of entry stopped a fugitive wanted on a no-bail felony warrant Friday attempting to use someone else’s legitimate border crossing card to illegally enter the United States and evade capture.
At about 3 p.m., Cristian Conception Montes Gonzalez arrived at the border crossing on foot, and presented the CBP officer with a legitimate border crossing card. The officer immediately recognized Gonzalez as an imposter, attempting to use a document that did not belong to him.
After confirming the 28-year-old male resident of Guadalajara, and Mexican citizen’s identity by fingerprint, CBP officers querying law enforcement databases discovered the no-bail felony warrant for a dangerous drugs-related offense, issued at the request of the Los Angeles Police Department.
CBP officers arrested the fugitive, who is currently being held at the San Diego County Jail. After the criminal proceedings are completed, he will be removed from the country.
“CBP officers won’t be deceived by an imposter trying to use someone else’s legal document to illegally enter the United States.” said Pete Flores, acting director of field operations for CBP in San Diego. “By catching criminal illegal aliens at the border, we keep these dangerous people off of our streets, and make our communities safer.”
CBP officers at the ports of entry along the California/ Mexico border stopped more than 200 illegal immigration attempts this weekend, including numerous other imposters to legitimate documents as well as persons hiding in vehicles, persons with altered travel documents, and other attempting to enter the U.S. illegally.
CBP officers also caught a fugitive wanted for a parole violation, with a no-bail warrant issued at the request of the Nevada Department of Public Safety. The 28-year-old male U.S. citizen, and resident of Reno, Nev., attempted to enter the U.S. with no identification or travel documents, based on an oral declaration. When the CBP officer queried his name, law enforcement databases revealed the warrant. CBP officers used fingerprints to confirm the man’s identity, Chaz Brandon Feilen, before arresting him. He is currently being held at San Diego County Jail.
In total, CBP officers caught 14 fugitives this past weekend along the California/Mexico border.

Charlotte, N.C. — U.S. Customs and Border Protection (CBP) at the Port of Charlotte welcomed agriculture canine “River” to the Port of Charlotte this month. River, an 18-month-old rescue dog, joined the ranks of CBP’s beagle and beagle mixed dogs working in international arrival terminals throughout the nation.
River met her handler at U.S. Department of Agriculture’s (USDA) National Detector Dog Training Center located in Newnan, Georgia while working through 12 weeks of intensive training. After graduation they returned to Charlotte-Douglas International Airport and began to do what River does best; find contraband.
“River is a great addition to the CBP family in the Port of Charlotte and we are excited to have her join us in our day-to-day activities in identifying potential prohibited agriculture products entering the U.S.,” said Barry Chastain, assistant port director.

The seizure occurred during an inspection of a commercial bus as it traveled through the Sarita Checkpoint. A K-9 team alerted to the luggage compartment of the bus and further inspection revealed close to 10 pounds of methamphetamine stitched inside the lining of a suitcase. Agents identified the owner, who claimed to be a Lawfully Admitted Permanent Resident. The man was placed under arrest.
The narcotics and the arrested individual were turned over to the Drug Enforcement Administration (DEA) for investigation.

Miami accountant pleads guilty in $31 million bank fraud scheme
MIAMI - Certified Public Accountant Berta Sanders, 61, of Miami Lakes, Fla., pleaded guilty on Oct. 29 to conspiracy to commit bank fraud, following an investigation led by the U.S. Immigration and Customs Enforcement (ICE) Office of Homeland Security Investigations (HSI).
From approximately November 2005 through March 2008, Sanders conspired to submit false loan applications to Wachovia Bank in order to obtain approximately $12 million in commercial lines of credit. Sanders promoted herself as someone who could help borrowers get approval for the lines of credit by preparing their loan applications.
Sanders prepared fraudulent loan applications on behalf of the borrowers, which contained false information about the borrowers' business income, assets and accounts receivable. Sanders also prepared false tax returns, bank statements and personal financial statements in connection with the line-of-credit applications.
As compensation for preparing the false loan applications that were submitted to Wachovia Bank, the borrowers paid Sanders a fee of approximately 10 percent of the loan amount. Sanders then paid a portion of these fees to a Wachovia bank officer as compensation for his assistance in preparing and processing the fraudulent applications.
During this scheme, Sanders conspired to obtain approximately $12 million in lines of credit from Wachovia Bank, which has resulted in approximately $10 million in losses to the bank. Sanders also admitted in court that between 2005 and 2008 she prepared additional fraudulent loan applications that have resulted in $19 million in losses to Wachovia. In total, Sanders is responsible for approximately $31 million in losses to the bank.
The investigation was conducted by ICE HSI in Miami, U.S. Secret Service and the City of Miami Police Department.
The case is being handled by Assistant U.S. Attorneys Andrew K. Levi and Richard Gregorie.

FORT LAUDERADLE, Fla. - Three Broward County, Fla., residents and one Miami resident were indicted on seven counts of narcotics trafficking for their participation in a conspiracy to possess and distribute multi-kilogram quantities of heroin, following an investigation by the U.S. Immigration and Customs Enforcement (ICE) Office of Homeland Security Investigations (HSI) and other federal, state and local agencies.
Indicted in the Southern District of Florida are Jose Wilson Ayala, aka "Junito," aka "Juanito," aka "Juni," aka "Junior," 35, of Davie, Fla.; Jose Alonso Escobar, aka "Colombia," aka "Flaco," 28, of Miami; Juan Luis Sanchez Valdez, 43, of Hollywood, Fla.; and Marko Roude, 28, of Davie, Fla.
The indictment charges all four with conspiracy to distribute more than one kilogram of heroin from March 2009 through Oct. 14. They are also charged with a number of individual counts of distribution and possession with intent to distribute heroin on specific dates. In addition, the indictment seeks the forfeiture of four vehicles used to facilitate the illegal narcotics trafficking and property constituting or derived from the proceeds of the defendants' drug trafficking.
If convicted, the defendants face a minimum of 10 years to life on the conspiracy charge, a minimum of five years to 40 years on count seven and up to 20 years on the remaining counts of distribution and possession with intent to distribute. The case has been assigned to U.S. District Court Judge James I. Cohn.
The investigation was conducted by ICE HSI in Ft. Lauderdale, Drug Enforcement Administration (DEA) Miami Field Division, Hollywood Police Department, Davie Police Department, Miramar Police Department, Miami-Dade Police Department, Broward County Sheriff's Office, and the Florida Highway Patrol (FHP).
This case is being prosecuted by Assistant U.S. Attorney Jennifer C. Millien.
An indictment is only an accusation and a defendant is presumed innocent until and unless proven guilty.

The City of Toronto is adding a pedestrian priority phase to the intersection of Bloor Street and Bay Street on November 3, providing pedestrians with the opportunity to cross safely in any direction including diagonally.
The pedestrian priority phase has been implemented in a number of other cities and has reduced conflict between pedestrians and vehicles by separating the flow of traffic and the movement of pedestrians.
Pedestrian priority intersections (or “pedestrian scramble”) were approved for use by City Council in 2007 and the first was installed at Yonge Street and Dundas Street in 2008. The Bloor-Bay intersection is the third in the city to receive this technology and is being implemented at the completion of the Bloor Street reconstruction project.
To help ensure the smooth transition to a pedestrian priority phase at Bloor Street and Bay Street, Toronto’s Transportation Services division will:
- Adjust the timing of lights to allow pedestrians to safely clear the intersection
- Enhance the Accessible Pedestrian Signals to assist the blind and visually impaired
- Monitor the intersection to determine whether any adjustments need to be made.
